The Law 289/02 art. 35, paragraph 7, and the Minister’s Decree 23 February 2006 n. 185, have provided methods and criteria for the identification of pupils with disabilities for the purposes of academic integration, specifying that this must occur through an ASST certified collegial determination.
The student must have already completed a diagnostic and functional overview, which has emerged from the presence of a situation of disability associated with the need to ensure school integration support. In Lombardy, the procedure to determine pupils with disability situations is governed by the guidelines issued by Regional Council Decision No. 2185 of 4 August 2011.
Registration
Before registration, it is necessary to ask the local ASST:
- the recognition of the pupil with disability carried out by a special and specific commission
- functional diagnosis, a fundamental document to enable the integration process (unlike the ASST collegial certification mentioned above, it is not limited to ascertaining the type and severity of the deficits but also points to the potential of the pupil - art. 3 24/02/94 DPR).
Before registration, it is useful to make contact with the school authorities of the pupil's catchment area to see if all the prerequisites for proper placement are in place (see P.O.F. - Plan of Studies).
Upon registration you must:
- present, in addition to the documentation required for all pupils, the above mentioned documents (identification of pupil with disability and functional diagnosis)
- indicate special needs (eg. Transport, food needs, therapies to follow, support for autonomy, needs related to accompaniment to the toilet).
The academic inclusion of students with disabilities is a real collectable subjective right: the school can not refuse to register and if it does, it is committing a civil and criminal offense.The registration of students with disabilities may not be refused even in the case where there is a number of entries exceeding the capacity of the school in accordance with the priority assigned to the art. 3 Law 104 (Art. 3 Law 104/92; C.M. 364/1986).
After Registration
The Headmaster invites the Academic Board to identify the most suitable class for the integration of pupils with disabilities (lett. B art. 4 of Presidential Decree 416/74).
The GLHO (Operative Handicap Work Group occupied in the individual case), formed by curricular teachers, support teachers, specialists and parents, creates a hypothetical project in which the support hours and personal assistants for autonomy and / or communication are quantified (art. 10 paragraph 5 of Law 122.2010).
The Headmaster, on the basis of the functional diagnosis and the above mentioned GLHO minutes, forwards the request to the Provincial School Office communicating the required support hours to local authorities and the number hours of necessary specialized assistance are needed (art. 42 and 44 Presidential Decree 616/77, art. 13 paragraph 3 of Law 104/92).
The GLHO writes the PEI (Individualized Education Plan), the overall project for the school inclusion of pupils with disabilities. The IEP contains the objectives, activities, planned interventions, supporting figures involved and the valuation criteria.
The classes in which there is a pupil with disabilities may not normally exceed the number of 20 pupils (81.2009 DPR).
